ATTORNEY FEE DISPUTES

It is not unusual for clients to be dissatisfied and upset over the attorney's fees charged by their own lawyers.  Sometimes the clients simply fail to recognize how expensive litigation may become and/or they do not understand how significant attorney's fees have been generated in the course of the representation.  On the other hand, clients often have legitimate complaints that attorneys have performed unnecessary or ineffective work which should not be charged to the client. 

There are a number of statutes and rules which protect clients and require attorneys to charge fair and reasonable fees for the work performed. California law requires that attorneys participate in a mandatory fee arbitration program conducted through local bar associations if the client requests it.  The arbitration is not binding unless both parties agree.  Generally, if any significant amount of money is at stake, the arbitration will be performed by a panel of three arbitrators including one non attorney.  These arbitrators volunteer their time and will usually try to complete the arbitration hearing in half a day.
